True or false? “There’s no point in doing a Pre-nup, they get overturned in court”

I’ve had many people tell me that. Are they right or wrong?

Wrong, if you have assets you want to protect for your future and your children’s future, you have a very good reason to get a Pre-nup. Also, Courts have held that people should be allowed to contract what they want and courts shouldn’t interfere with that.

While it’s true that some Pre-nups have been overturned in Court, if your lawyer specialises in relationship property, they will draft an agreement that suits your specific circumstances and will ensure it remains binding, even when your circumstances change.

A Pre-nup that can be relied upon in the worst scenario that your relationship ends (through separation\death) will give you the peace of mind that your assets are secure for your future and your children’s future. Then you can enjoy your relationship without worrying about that worst case scenario.
