Some people joke that if they win lotto, they will leave their partner so they won’t have to share the winnings. They usually get a big surprise to find that they will still have to share the winnings . That’s because all property (with some exceptions) acquired after the relationship began is relationship property. This includes lotto winnings, salary\wages, holiday pay, redundancy payments, superannuation such as KiwiSaver, disability insurance payout and tax refunds.
If you want to make sure you don’t have to share your lotto winnings, you’re going to need a Contracting Out Agreement (Prenup). Contact me for a free 15 minute call on 021 077 7785 or email me at Hayley@caringestates.co.nz
