Most of my clients are surprised to find out that trust property is not protected from a relationship property claim, particularly if the property was transferred during your relationship and especially if used as part of your relationship.
For example, if your partner\spouse contributes towards your home such as gardening, farming, maintenance, taking care of your children, he\she may be compensated for their contributions should the relationship ends after 3 years. Also, if you regularly use trust funds to support your lifestyle such as going on family holidays together, then your spouse\partner may claim compensation from the trust funds if you separate.
Many people put their property in a trust to protect it from a relationship property claim and many learn the hard way that it doesn’t fully protect them. The only way to be fully protected is with a Contracting Out Agreement (pre-nup).
